1. Acceptance of Terms

By accessing our website (freewillydivingboracay.com), making a booking, or participating in any diving activity with Free Willy Diving Boracay ("we," "us," or "our"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our services or website.

2. Eligibility & Age Requirements

• Minimum age for scuba diving: 10 years old (with parental consent for minors).

• Bubble Maker Program: Strictly for children aged 8–9 years old only, with a parent or guardian present.

• Discover Scuba Diving / Try Dives: Open to beginners aged 10+ (parental consent required for under 18).

• PADI Certification Courses: Open to certified divers or those completing the Open Water course (minimum age 10).

We reserve the right to refuse service to anyone who does not meet safety or medical requirements.

3. Medical & Fitness Requirements – What You Should Know Before Diving

Scuba diving involves physical exertion and changes in pressure. It is essential that you are in good health. Before booking or diving, please honestly answer the following:

You must inform us if you have or have ever had any of the following conditions:

• Heart disease, high blood pressure, or previous heart attack

• Asthma, COPD, or any lung/breathing problems

• Diabetes (especially if insulin-dependent)

• Epilepsy, seizures, or fainting spells

• Pregnancy (current or suspected)

• Recent surgery, injuries, or ear/sinus problems

• Any condition that may affect your ability to dive safely

Important: If you answer “YES” to any medical question on our diving medical questionnaire, you will need a physician’s approval (signed medical statement) before diving. We take your safety seriously — please be honest. Hiding medical conditions can be dangerous and may void insurance coverage.

We strongly recommend that all divers (especially those over 40 or with any medical history) consult a doctor familiar with diving medicine before participating.

4. Risks of Diving & Assumption of Risk

Scuba diving is an adventurous activity that carries inherent risks, including but not limited to: decompression sickness (the bends), barotrauma, drowning, marine life injuries, equipment failure, strong currents, and changing weather/sea conditions. By participating, you acknowledge that you understand these risks and voluntarily assume them.

You agree to follow all instructions from our instructors and dive professionals at all times. Failure to do so may result in removal from the dive without refund.

5. Liability Waiver & Release

To the fullest extent permitted by law, you hereby release, waive, and discharge Free Willy Diving Boracay, its owners, instructors, staff, and agents from any and all liability, claims, demands, or causes of action arising from your participation in diving activities, including negligence. This waiver does not apply to gross negligence or willful misconduct.

You agree that any dispute arising from these terms or your diving experience shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be governed by the laws of the Republic of the Philippines and subject to the exclusive jurisdiction of the courts in Aklan Province.

6. Booking, Payment & Cancellations

All bookings are subject to our separate Refund & Cancellation Policy (available on our website). Key points:

• A non-refundable deposit may be required to secure your spot.

• Full payment is due before the activity begins (or as specified at booking).

• We accept cash (PHP), major credit cards, bank transfer, and e-wallets.

7. What to Bring & What We Provide

We provide:

• Full scuba equipment (BCD, regulator, tank, weights, mask, fins, wetsuit)

• Towels, drinking water, and light snacks on boat trips

• Professional instruction and supervision

You should bring:

• Swimsuit, sunscreen, hat, and sunglasses

• Any personal prescription dive mask (if you have one)

• Motion sickness medication if you are prone to seasickness

• Valid photo ID and dive certification card (if certified)

8. Photography & Media Release

We may take photos and videos during your dive for safety, training, and promotional purposes. By participating, you grant us permission to use these images and videos on our website, social media, and marketing materials. If you prefer not to be photographed, please inform us before the dive. We will respect your request.

9. Code of Conduct & Environmental Responsibility

We are committed to protecting Boracay’s beautiful marine environment. You agree to:

• Follow all instructions from our team

• Never touch, stand on, or damage coral reefs

• Not collect or remove any marine life or artifacts

• Practice proper buoyancy control to avoid reef contact

• Respect other divers and maintain good buoyancy

We reserve the right to end any dive early if a diver’s behavior endangers themselves, others, or the marine environment.

10. Governing Law & Disputes

These Terms & Conditions are governed by the laws of the Republic of the Philippines. Any disputes shall be resolved through good-faith negotiation first. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts in Malay, Aklan, Philippines.
